Terms and Conditions – British Diesel Systems

1. Overview

This website is operated by British Diesel Systems (Gilcorp Limited). Throughout the site, the terms “we”, “us”, and “our” refer to British Diesel Systems, including our suppliers and partners.

By accessing our website and/or purchasing from us, you engage in our “Service” and agree to be bound by these Terms and Conditions (“Terms”). These Terms apply to all users, including retail consumers, businesses, vendors, resellers, and contributors of content.

If you are a consumer, these Terms apply alongside your statutory rights, which are not affected. If you are a business customer, these Terms form the entire agreement between us and you, overriding any other terms unless agreed in writing.

We may update these Terms at any time by posting changes on our website. Your continued use of our website or services after changes are published means you accept the updated Terms.

2. Online Store Terms

You must be at least the age of majority in your jurisdiction to use this website.

You may not use our products for unlawful purposes or in violation of applicable laws.

Any breach of these Terms may result in immediate suspension or termination of service.

3. Orders and Payment

Retail Customers: Payment is due in full at checkout.

Business Customers: Unless otherwise agreed in writing, payment is due within 30 days of the invoice date. We may charge statutory interest and debt recovery costs under the Late Payment of Commercial Debts (Interest) Act 1998 on overdue invoices.

We reserve the right to refuse or cancel any order, limit quantities, or restrict sales to any customer or region.

Prices may change without notice and exclude VAT unless stated.

3A. International Orders, Customs Duties, Import Taxes and Clearance Charges

For orders delivered outside the United Kingdom, the customer is responsible for any customs duties, import taxes, tariffs, VAT, brokerage fees, clearance fees, handling fees, storage fees, or any other charges imposed by the destination country, customs authority, courier, postal service, or delivery provider.

These charges are not included in the price of our products or shipping costs unless we expressly state otherwise in writing or they are clearly shown at checkout as being included.

The customer is the importer of record and is responsible for ensuring that the goods can be lawfully imported into the destination country. We are not responsible for delays, additional charges, seizure, return, abandonment, destruction, or refusal of goods caused by customs checks, unpaid import charges, incorrect customer information, or import restrictions in the destination country.

If the customer refuses to pay customs duties, import taxes, clearance charges, courier handling fees, or any other required import costs, or refuses or fails to accept delivery, the order will be treated as refused by the customer and not as a cancellation by us.

In these circumstances, the customer will not be entitled to a refund of the product price, original shipping cost, or any customs, courier, clearance, storage, return, handling, or payment processing charges incurred, except where we are legally required to provide a refund.

If the goods are returned to us by the courier or customs authority, we may, at our sole discretion, offer a partial refund only after deducting all costs incurred by us, including but not limited to original shipping, return shipping, customs charges, courier fees, storage fees, handling fees, payment processing fees, and any loss in value of the goods.

If the goods are abandoned, destroyed, seized, or not returned to us because the customer failed or refused to pay the required import charges or failed to complete customs clearance, no refund will be due, except where required by law.

By placing an international order, the customer acknowledges and agrees that they are responsible for all customs, import, tax, and clearance charges payable in the destination country.

4. Products and Services

Certain products are available only online and may have limited quantities.

Images and descriptions are for reference only; actual product details may vary.

We may discontinue products or services at any time.

Some remanufactured injection pumps may contain non-genuine parts where originals are obsolete or unavailable.

We do not guarantee that products will meet your specific expectations or requirements.

Modified Products:

Any products that have been altered from the manufacturer’s original specification, for example fuel pumps adjusted to deliver increased fuel or other performance modifications, are supplied strictly without warranty or guarantee.

By purchasing such products, you accept that they fall outside the manufacturer’s recommended tolerances and are used entirely at your own risk.

5. Returns and Refunds

Retail Customers: Returns are accepted in accordance with our Returns Policy and UK consumer law.

Business Customers: Goods are non-returnable unless defective, supplied incorrectly, or expressly agreed in writing. Any return must be authorised by us in advance.

6A. Special Orders and Remanufactured Items

Non-Returnable: Special order items, custom-built parts, and any goods manufactured, remanufactured, or refurbished to order are non-returnable and non-refundable once the order has been confirmed. This includes, but is not limited to, items specifically sourced at your request or remanufactured injection pumps and injectors built to specification.

Payment Terms: Full or partial payment may be required in advance for such orders, and cancellations will not be accepted once work has begun.

Risk and Responsibility: By placing an order for a special or remanufactured item, you acknowledge and agree that such goods cannot be resold by us in the ordinary course of business and therefore are supplied on a strictly no-return basis.

7. Core Returns (Exchange) Policy

Certain items, such as fuel injection pumps and injectors, are sold on an exchange basis. The price includes a refundable “core charge” if you return your old unit in acceptable condition.

Conditions for a valid return:

Core must match the part supplied.

It must be complete, not disassembled, and free from cracks, missing parts, fire/water damage, or severe corrosion.

Cores must be returned within 14 days unless otherwise agreed.

Inspection is carried out by our technicians. Refunds, if applicable, are processed within 5–10 business days.

Cores rejected as unfit for refurbishment will not be refunded. Customers may request return shipping, for which charges apply, or allow us to dispose of them.

By purchasing exchange products, you accept these conditions.

8. Accuracy of Information

We aim for accuracy but cannot guarantee that all information on our site, including pricing, descriptions, or availability, is complete, current, or error-free. We may correct errors or update information at any time without notice.

9. Third-Party Tools and Links

We may provide access to third-party tools or links on an “as is” basis, without warranties.

We are not responsible for third-party content, products, or services. Any use of third-party tools or engagement with third-party sites is at your own risk.

10. Customer Content

If you submit comments, feedback, or other content to us, you grant us a royalty-free, perpetual licence to use, modify, and distribute that content. You must not submit unlawful, infringing, or harmful material.

11. Personal Information

Use of your personal data is governed by our Privacy Policy.

12. Warranty and Liability

12.1 Retail Customers (Consumers)

Nothing in these Terms limits or excludes our liability for:

death or personal injury caused by our negligence;

fraud or fraudulent misrepresentation; or

your statutory rights under the Consumer Rights Act 2015.

Where goods supplied, repaired, remanufactured, or refurbished by us are found to be defective, our liability is limited to the remedies available under consumer law, including repair, replacement, or refund, as applicable.

We are not responsible for damage or failure caused by misuse, incorrect installation, incorrect commissioning, incorrect calibration, operation outside manufacturer or industry-standard specifications, or failure to follow fitting, operating, or maintenance instructions.

12.2 Business Customers (B2B)

To the fullest extent permitted by law, all warranties, conditions, and other terms implied by statute or common law are excluded.

Our sole liability is limited, at our discretion, to the repair or replacement of the goods supplied or services carried out, or a refund of the price paid for those goods or services.

We shall not be liable for any indirect, incidental, special, or consequential loss or damage, including but not limited to loss of profit, loss of production, loss of contracts, loss of use, downtime, business interruption, or loss of data.

Our total aggregate liability, whether in contract, tort including negligence, or otherwise, shall not exceed the amount paid for the specific goods or services giving rise to the claim.

12.3 Installation, System Damage & Heavy-Duty / Marine Use Applies to All Customers

Goods supplied, repaired, remanufactured, or refurbished by us are components intended to be installed within larger systems. The customer is responsible for ensuring that installation, refitting, commissioning, calibration, and operation are carried out by suitably qualified and competent personnel.

To the fullest extent permitted by law, we accept no liability for damage to or failure of any engine, machinery, plant, vessel, generator, power unit, industrial equipment, or associated systems arising from or connected with:

incorrect installation, refitting, commissioning, timing, calibration, or adjustment;

fuel contamination, poor fuel quality, or system contamination;

pre-existing defects, wear, fatigue, overheating, lubrication failure, or incorrect system pressures;

failure of components not supplied, repaired, or remanufactured by us; or

operation or use outside manufacturer recommendations or industry-standard specifications.

Our responsibility is strictly limited to the goods supplied or the work carried out by us and does not extend to system-wide damage, secondary failures, or losses affecting other components or equipment.

12.4 Modified and Non-Standard Products

Where a customer requests that we modify, alter, or adjust a product beyond the manufacturer’s original specification, including but not limited to changes in fuel delivery, calibration, or performance settings, such work is carried out entirely at the customer’s own risk.

Any product supplied by us that has been modified beyond the manufacturer’s recommended tolerances, whether modified at the customer’s request or supplied by us in such condition, is provided without warranty or guarantee. We accept no liability for its performance, durability, or for any damage caused to engines, machinery, or associated systems arising from its use.

By purchasing or requesting such modified products, you acknowledge and accept these risks in full.

13. Indemnification

You agree to indemnify and hold us harmless against claims, damages, costs, and expenses, including legal fees, arising from your breach of these Terms or misuse of our services.

14. Force Majeure

We are not responsible for delays or failure to perform caused by events beyond our reasonable control, including supply chain disruptions, strikes, accidents, natural disasters, or transport delays.

15. Termination

We may suspend or terminate your access to services if you breach these Terms. Any obligations relating to payments, liabilities, warranties, indemnities, or limitations of liability will continue after termination.

16. Governing Law

These Terms and any related contracts are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.

17. Trademarks

All trademarks referenced are the property of their respective owners and are used for identification purposes only.
